MINUTES OF THE
CITY OF SAN RAMON – COUNCIL MEETING

September 11, 2007

A regular meeting of the City Council of the City of San Ramon was held September 11, 2007 at 7:07 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Mayor Wilson presiding.

PRESENT: Councilmembers Hudson, Livingstone, Rowley, Vice Mayor Perkins, and Mayor Wilson.

STAFF PRESENT: City Manager Herb Moniz, City Attorney Byron Athan, Acting Police Chief Joe Gorton, Planning Services Manager Debbie Chamberlain, and City Clerk Patricia Edwards.

PLEDGE OF ALLEGIANCE

Lori Bennardo led the staff and the audience in the pledge of allegiance.

ANNOUNCEMENTS

Mayor Wilson asked if there were any changes or additions to the agenda. The City Clerk noted that there were none.

Mayor Wilson asked if there were any changes or additions to the Boards, Committee and Commission meetings schedule. The City Clerk noted that there were two changes. The Architectural Review Board meeting scheduled for Sept. 13, 2007 has been cancelled. The Zoning Administrator will hold a meeting on September 13, 2007.

SPECIAL PRESENTATIONS

(#4.1) Recognizing City Read 2007 "Two Cities, One Book" – September 17, 2007 – October 29, 2007.

Mayor Wilson presented the City Read 2007 Proclamation to Danville’s Mayor Michael K. Shimansky. This year’s book is Locked Rooms by California author Laurie R. King.

Amy McKosky, San Ramon Library Youth Services Librarian, applauded the cooperative effort between San Ramon and Danville which utilizes the City Read promotion to encourage reading. Ms. McKosky informed the Council that in April 2008, the program will expand to include a "Kids Read" component. Seng Lovan, Danville Senior Branch Librarian, thanked the mayors for their support and stated that free copies of the book are available in libraries and various locations in both San Ramon and Danville. She invited readers to attend the closing program on November 9, 2007 which will feature author Laurie R. King at the Danville Village Theater. Ms. McKosky recognized Eileen Dowell, Library Advisory Committee member, and thanked the Library Foundation for the funds which purchased the books.

Mayor Shimansky commended the City of San Ramon for an excellent 9/11 program.

(#4.2) Proclamation Recognizing September 2007 as Ovarian Cancer Awareness Month.

Mayor Wilson presented the Proclamation to Stacey Hartmann and thanked her for promoting awareness of Ovarian Cancer. Ms. Hartman, representing the National Ovarian Cancer Coalition, thanked the Council for recognizing the importance of early detection. Because the symptoms are not usually recognized until the advanced stages of the disease, Ms. Hartman noted that ovarian cancer is called the "disease that whispers".

(#4.3) Introduction of New City Staff: Debbie Hince, Office Technician II, Planning Services.

Planning Services Manager Debbie Chamberlain introduced Debbie Hince and reviewed her duties in the Planning Department. Mayor Wilson welcomed her into the San Ramon family and presented her with a City pin. Ms. Hince stated that she is very happy to be working for San Ramon and that the City staff is very friendly.

(#4.4) Recognition of Renee Beck, Deputy City Clerk, as Employee of the Month for September 2007.

City Clerk Patricia Edwards introduced Renee Beck. Ms. Edwards recognized Ms. Beck for the assistance which she provided to the Police Department in obtaining a naturalization document for one of their officers. The Police Department needed this documentation order to obtain its Police Officer Standardized Training certification. Ms. Beck was also recognized as a hard working employee who has made several significant contributions to the City Clerk’s office in her ten month tenure.

Mayor Wilson presented Ms. Beck with a certificate and a gold star and thanked her for her contributions to the City. Ms. Beck thanked the Council for this recognition and said that she is proud to be working for the City.

CITY COUNCIL APPOINTMENTS

PUBLIC COMMENT

The City Clerk noted that there were two requests for public comment.

Mike Conklin, along with Joey Bozik and Manny Del Rio, recipients of the Sentinels of Freedom program, presented Mayor Wilson with an American flag which was flown in a combat mission over Afghanistan on June 4, 2007 and a plaque commemorating the event as part of Operation Enduring Freedom. Mayor Wilson stated that he was very appreciative of this recognition and an honor to be in the presence of the Sentinels of Freedom recipients. He is proud to be part of the San Ramon community which recognizes the importance of and contributes to the Sentinels program.

Doug Burr, a San Ramon resident, requested that the City Council take action and support a resolution which would keep the speed limit on Windemere Parkway and East Branch Parkway at 30 mph instead of the County’s plans to increase it to 45 mph. Mayor Wilson thanked Mr. Burr for bringing this item to the Council’s attention and stated that he will forward this item to appropriate City staff to evaluate. He stated that resident safety is of paramount concern to the Council and that this is not a Dougherty Valley problem but a City problem. He stated that the Council will follow the proper procedures so that any action taken will be done legally.

APPROVAL OF MINUTES

Vice Mayor Perkins’ motion to approve the August 28, 2007 minutes was seconded by Cm. Rowley and passed 5-0.

CONSENT CALENDAR

Mayor Wilson requested that item 8.2 be pulled.

(#8.1) Ordinance No. 397 – Changing Municipal Code References from "Sheriff" and "Sheriff’s Department" to "City of San Ramon Police Chief" and "City of San Ramon Police Services Department" Respectively.

(#8.3) Minute Order No. 2007-17 – City Council Consent to Transfer of All Rights and Liabilities of DCO Mill Creek, L.P. to Essex Portfolio, L.P. (or its designated affiliates) Under the Development Agreement Entered into by Windemere Ranch Partners and Contra Costa County.

(#8.4) Resolution No. 2007-155 – Accepting Certain Landscape Easement Dedications and Certain Landscape Improvements in RA 1117 (Monarch Road) for Maintenance (Shapell Industries - Monarch at Gale Ranch).

(#8.5) Resolution No. 2007-156 – Accepting Certain Service Roads, Access Roads, Storm Drainage Facilities, and Associated Appurtenances Within RA 1114 for Maintenance (Shapell Industries – Monarch, Veranda, and Gallery at Gale Ranch).

(#8.6) Resolution No. 2007-157 – Authorizing the Mayor to Execute an Agreement with Econolite Traffic Engineering and Maintenance, Inc. for Traffic Signal Maintenance and Emergency Callout Services in an Annual Amount Not to Exceed $129,500 for FY 2007/08.

(#8.7) Resolution No. 2007-158 – Authorizing the Mayor to Approve an Agreement between the San Ramon Valley Fire District and the City of San Ramon for the Purpose of Mutually Assisting with the Cost of Needed Public Improvements.

Vice Mayor Perkins’ motion to adopt consent calendar items 8.1 and 8.3 through 8.7 was seconded by Cm. Livingstone and passed 5-0.

(#8.2) Minute Order No. 2007-16 – Authorizing Vice Mayor Perkins and Councilmember Rowley to Attend the America’s Promise Alliance’s National Forum in Washington, D.C. on October 10-11, 2007 and Cancelling or Rescheduling the October 9, 2007 City Council Meeting.

Mayor Wilson requested that the Council vote only on authorizing the travel of Vice Mayor Perkins and Cm. Rowley and not on the decision to cancel or reschedule the October 9, 2007 Council meeting.

Vice Mayor Perkins’ motion to adopt consent calendar item 8.2 as amended was seconded by Cm. Hudson and
passed 5-0.

CITY MANAGER COMMENTS

City Manager Herb Moniz had no comments.

COUNCILMEMBER REPORTS

Councilmember Hudson reported on the sessions which he attended at the League of California Cities’ Annual Conference. He was concerned by Lt. Gov. Garamendi’s statement that the ocean will rise 6" to 18" in the next 20 to 50 years even if we return to 1990 green house gas levels. He warned that the City may loose funding if the City does not address the green house gas and global warming issues in future reports and action.

Vice Mayor Perkins commented that the League’s Conference was very informative. He was impressed with the exhibitors and interesting new technologies.

Cm. Livingstone invited the public to attend the Rotary Club of San Ramon’s 23rd Annual Carbo Load party scheduled for September 29, 2007 at the Toyota facility in San Ramon. The monies raised by the Rotary Club are returned to the community. The cost is $20 per person and children under 10 are free. This is a family pasta party with entertainment for children, music, dancing, the "Astro Wizard", and a silent auction.

Mayor Wilson encouraged residents to attend the event and support the community.

Cm. Rowley invited elementary principals to participate in the Carbo Load’s Pasta Sauce Competition. She encouraged students to support the event. The grand prize is $1,000 for the winning school. She stated that she enjoyed attending the League’s Conference and was impressed with the sessions.

MAYOR’S REPORTS AND COMMENTS

Mayor Wilson asked residents to collect produce stickers and put them on the contest card for the Mayor’s Produce Sticker Challenge. He reminded residents to visit the Farmers Market on Saturdays. He thanked everyone who worked to provide a very moving 9/11 Event and recognized the contributions of the Parks Department and the Exchange Club of San Ramon Valley. He invited residents to attend the City Council and Parks and Community Services Commission meeting on September 12, 2007. They will discuss the Draft Parks and Community Services Master Plan and Strategic Action Plan. Citizens who are interested in emergency preparedness can attend the San Ramon Valley Emergency Preparedness Fair on September 15, 2007. He invited residents to attend the California Symphony’s free concert on September 16, 2007 at Central Park. Mayor Wilson closed the meeting in honor of the people who perished on September 11th and their families, and all the men and women fighting today for our nation’s freedom.

At 7:55 p.m., there being no further business, Mayor Wilson adjourned the meeting.
