MINUTES OF THE May 22, 2007 A regular meeting of the City Council of the City of San Ramon was held May 22, 2007 at 7:07 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Mayor Wilson presiding. PRESENT: Councilmembers Hudson, Livingstone, Rowley, Vice Mayor Perkins, and Mayor Wilson. STAFF PRESENT: City Manager Herb Moniz, City Attorney Byron Athan, Police Chief Scott Holder, Central Services Division Manager (Loss Control Safety Advisor) Pat Perry, Engineering Services Director Joye Fukuda, Parks and Community Services Director Jeff Eorio, Senior Engineer Robin Bartlett, and City Clerk Patricia Edwards. * * * * PLEDGE OF ALLEGIANCE Cm. Dave Hudson led the staff and the audience in the pledge of allegiance. * * * * ANNOUNCEMENTS Mayor Wilson asked if there were any changes or additions to the agenda. The City Clerk noted two changes. Staff requested that item 8.10 be removed from the agenda. Staff also requested that item 9.2 be pulled because required noticing was not posted. Mayor Wilson asked if there were any changes or additions to the Boards, Committee and Commission meetings schedule. The City Clerk noted that the final Character Counts! Parent Night will be held on May 31, 2007 at the Dougherty Station Community Center, West Meeting Room, at 7:00 p.m. The last Teen Council meeting will be held on June 5, 2007 at The Loft at Dougherty Station Community Center at 6: 30 p.m. * * * * SPECIAL PRESENTATIONS (#4.1) Recognition of ENGEO Incorporated as the Recipient of the East Bay Business Times’ Award as the "Best Place to Work in the Bay Area for 101-500 Employees". Mayor Wilson presented Uri Eliahu, President of ENGEO Incorporated, and members of his staff with a proclamation recognizing ENGEO Incorporated as recipient of the East Bay Business Times’ "Best Place to Work in the Bay Area for 101-500 Employees" award. Mayor Wilson remarked that residents sometimes take for granted the exceptional community in which they live. Mayor Wilson stated that ENGEO is a family that works hard and plays hard together. Mr. Eliahu thanked the Council and staff for the recognition. He is proud of this recognition, of the ENGEO family, and of San Ramon. He expressed his appreciation for the support from the City Council and City staff. (#4.2) Proclamation Declaring June 2007 as National Safety Month. Mayor Wilson presented Pat Perry, Central Services Division Manager and Loss Control Safety Advisor with the proclamation declaring June 2007 as National Safety Month. (#4.3) Recognition of Receipt of Certificate of Loss Control Accreditation – Level 2/3 Award Received by the Municipal Pooling Authority on Behalf of the City’s Employee Safety Committee. On behalf of the City’s Employee Safety Committee, Pat Perry, Central Services Division Manager and Loss Control Safety Advisor, presented Mayor Wilson with a check for $2,000 from the Municipal Pooling Authority (MPA). Ms. Perry also presented Mayor Wilson with a plaque from the MPA recognizing the City for successfully completing the conditions of eligibility for Level 2 of the Loss Control Credit Program for June 2006 through June 2007. Mayor Wilson thanked the Safety Committee for their work. (#4.4) Introduction of New City Employees: Karl Shogren, Senior Inspector, Engineering Services; Brian Bornstein, Senior Engineer, Engineering Services; and Mabel Quon, Office Technician, Parks and Community Services. Engineering Services Director Joye Fukuda introduced two new Engineering Services employees: Karl Shogren, Senior Inspector, and Brian Bornstein, Senior Engineer. Mr. Shogren will be working on the Old Ranch Box Culvert Repair and Pavement Management projects. Mr. Shogren thanked everyone for the wonderful welcome and said that he is excited to work on City projects which will benefit citizens. Mr. Bornstein is a licensed engineer assigned to the City Center project. He thanked the City and stated that he is excited to begin his San Ramon career and become part of the San Ramon family. Parks and Community Services Director Jeff Eorio introduced Mabel Quon who will be working at the front counter at Dougherty Station Community Center. Ms. Quon said she is excited to be a part of the great Parks Department staff and San Ramon community. Mayor Wilson welcomed the new employees and presented each of them with a City pin. * * * * CITY COUNCIL APPOINTMENTS * * * * PUBLIC COMMENT The City Clerk noted that there was one request for public comment. Carolyn Degnan, President and CEO of the San Ramon Chamber of Commerce, provided an eight month update to the Council. She has implemented many new policies and procedures and is working on a five-year strategic plan. Her two primary goals are fiscal responsibility and membership growth. She invited the Council to review the Chamber’s new website and encouraged them to attend the variety of Chamber events. Vice Mayor Perkins thanked Ms. Degnan and the Chamber for their work in promoting San Ramon. Cm. Rowley noted that the Chamber sponsors great events. * * * * APPROVAL OF MINUTES Vice Mayor Perkins’ motion to approve the May 8, 2007 minutes was seconded by Cm. Livingstone and passed 5-0. * * * * CONSENT CALENDAR The City Clerk noted that there are now nine items on the Consent Calendar. In item 8.3, Resolution No. 2007-87 has been modified to include section #5 which incorporates the change requested by the Council at their May 21, 2007 Budget Workshop. Mayor Wilson reported that the Council requested an additional $40,000 from the General Fund be added to the Police Department budget to fund a Sentinels of Freedom position. The Council is honored and pleased to provide this employment opportunity to Petty Officer Manny Del Rio and welcome him to the San Ramon family. (#8.1) Ordinance No. 392 – Authorizing an Amendment to the Contract Between the City Council of the City of San Ramon and the Board of Administration of the California Public Employees Retirement System. (#8.2) Ordinance No. 393 – Amending Section A7-6, Public Works Contracts, of Chapter I, Contract Authority, of Division A7, Contract and Procurement Authority, of Title A, General and Administration, of the Municipal Code of the City of San Ramon. (#8.3) Resolution 2007-87 – Adopting the 2007-2008 Operating and Capital Budget, Establishing an Appropriation Limit, and Authorizing Carryover Appropriations. (#8.4) Resolution No. 2007-88 – Authorizing the Mayor to Execute an Agreement with ENGEO, Inc. for On-Site Geotechnical Review and Material Testing Services for the Senior Center Expansion Project (CIP 5424) in an Amount not to Exceed $80,000. (#8.5A) Resolution No. 2007-89 – Authorizing the Mayor to Execute an Agreement with FloraTech Landscape Management, Inc. for Providing Park Turf Mowing Services for One Year and with Four - One Year Extension Options Under Such Terms, Conditions and Annual Amounts as Approved by the City Manager and in a Current Amount not to Exceed $274,388. (#8.5B) Resolution No. 2007-90 – Authorizing the Mayor to Execute an Agreement with White Oak Landscape, Inc. for Providing Park Turf Mowing Services for One Year and with Four - One Year Extension Options Under Such Terms, Conditions and Annual Amounts as Approved by the City Manager and in a Current Amount not to Exceed $178,306. (#8.6) Resolution No. 2007-91 – Authorizing the Expenditure of Additional Funds to Mark One Visual Communications for the 2007/08 Youth Transit Ticket Program Brochures. (#8.7) Resolution No. 2007-92 – Authorizing an Amendment to the Contract with the Contra Costa County Office of the Sheriff for Law Enforcement Services Provided to the City of San Ramon. (#8.8) Resolution No. 2007-93 – Authorizing the Purchase and Equipping of Two Replacement Patrol Vehicles in the Amount of $56,692 from the Police Vehicle Replacement Fund. (#8.9) Minute Order No. 2007-09 – Authorizing the Purchase of One Police Canine Vehicle in the Amount of $42,000. (#8.10) Resolution No. 2007-94 – Appropriating $70,000 from the South Contra Costa Joint Exercise of Power Authority Fund and Authorizing the Mayor to Execute an Agreement with Redgwick Construction Co. for the Construction of the Bollinger Canyon Road at Alcosta Boulevard Interim Widening Project (CIP 5320) in an Amount not to Exceed $ 333,688. Vice Mayor Perkins’ motion to adopt consent calendar items 8.1 through 8.9 and the Resolution in item 8.3 as revised was seconded by Cm. Livingstone and passed 5-0. * * * * UNFINISHED BUSINESS (#9.1) Public Hearing: Geologic Hazard Abatement District No. 1990-01 – Consideration of Resolution No. 2007-95 –Confirming and Levying the Assessment for the Geologic Hazard Abatement District No. 1990-01 for Fiscal Year 2007/08. Robin Bartlett, Senior Engineer, provided the Geologic Hazard Abatement District (GHAD) report. He requested that the Council confirm the Engineer’s Report and adopt Resolution No. 2007-95 which authorizes the levy and collection of an assessment of $111.44 per residential unit and 0.0357 per square foot of non-residential building space for the GHAD for Fiscal Year 2007/08. In response to the required annual noticing of property owners within the GHAD, Mr. Bartlett reported that only two comments were received. One resident questioned the need for the GHAD increase and the other resident asked if a senior discount was available. There were no questions from the Council. Mayor Wilson opened the public hearing. There were no requests to address this item. Mayor Wilson closed the public hearing. Cm. Hudson’s motion to adopt Resolution No. 2007-95 confirming and levying the assessment for FY 2007/08 for Geologic Hazard Abatement District No. 1990-01 was seconded by Cm. Rowley and passed 5-0. (#9.2) Public Hearing: Landscaping and Lighting District No. 1984-1 – Consideration of Resolution No. 2007-96 – Confirming the District Diagram and Assessments and Levying the Assessments for the Landscaping & Lighting District No. 1984-1 for Fiscal Year 2007/08. * * * * NEW BUSINESS * * * * CITY MANAGER COMMENTS City Manager Herb Moniz stated that he had no comments. * * * * COUNCILMEMBER REPORTS Cm. Rowley encouraged residents to sign up for the June 30 – July 1, 2007 Relay for Life Days in San Ramon. This event benefits the American Cancer’s Society. Vice Mayor Perkins encouraged residents to take advantage of the Saturday Farmers’ Market and to attend the annual Art and Wind Festival on May 27-28, 2007. * * * * MAYOR’S REPORTS AND COMMENTS Mayor Wilson announced that City offices will be closed on May 28, 2007. He encouraged residents to attend the Art and Wind Festival and the Farmers’ Market.
