MINUTES OF THE February 13, 2007 A regular meeting of the City Council of the City of San Ramon was held February 13, 2007 in the City Council Chamber at City Hall, 2222 Camino Ramon, Mayor Wilson presiding. The meeting convened to Closed Session at 6:02 p.m. PRESENT: Councilmembers Hudson, Livingstone, Rowley, Vice Mayor Perkins, and Mayor Wilson. STAFF PRESENT: City Manager Herb Moniz, City Attorney By Athan, Police Chief Scott Holder, Economic Development Director Marc Fontes, Parks and Community Services Director Jeff Eorio, Engineering Services Director Joye Fukuda, Central Services Division Manager Pat Perry, Public Services Director Karen McNamara, Community Services Division Manager John Skeel, Transportation Division Manager Lisa Bobadilla, and City Clerk Patricia Edwards. * * * * CLOSED SESSION At 6:02 p.m., the Council met in closed session pursuant to Government Code §54957 to meet with its labor negotiators, Jeff Eorio, Greg Rogers, and Cheryl Mitchell Wade – SEIU Local 790. No action was taken by the Council. At 7:10 p.m., Mayor Wilson reconvened the meeting. All Councilmembers were in attendance. * * * * Convene to Joint Public Hearing with the Redevelopment Agency to consider the Expenditure of Monies by the Redevelopment Agency for the Installation and/or Construction of Certain Public Improvements Projects. Mayor Wilson convened the City Council to the Joint Public Hearing at 7:10 p.m. Agency Chair Perkins reconvened the Agency to the Joint Public Hearing at 7:10 p.m. Mayor Wilson announced that the purpose of the meeting is to conduct a joint public hearing with the Redevelopment Agency to consider Council Agenda Item 1.1, the Expenditure of Monies by the Redevelopment Agency for the Installation and/or Construction of Certain Public Improvements Projects, and Redevelopment Agency Item 9.1 to consider the Expenditure of Monies by the Redevelopment Agency for the Installation and/or Construction of Certain Public Improvements Projects. Upon the conclusion of the hearing, the Council will consider and act upon resolutions authorizing the proposed funding by the Redevelopment Agency. All members of the Council and Redevelopment Agency were in attendance. Mayor Wilson opened the public hearing. Deputy Executive Director Marc Fontes provided a summary of the public improvements projects and the amount of proposed funding by the Redevelopment Agency. He presented the Agency Secretary with two exhibits. Exhibit 1 was the Proof of Publication of notice of the public hearing. Exhibit 2 was the Summary Report required by Health and Safety Code Section 33679. There were no questions by members of the City Council or Redevelopment Agency Board. Mayor Wilson requested that any written comments concerning the subject matter of this public hearing be entered into the record of this public hearing. The Agency Secretary reported that no written communication was received by the City. Mayor Wilson requested statements or testimony from those present. The Agency Secretary reported that there were no public comment requests to address this item. Mbr. Hudson requested procedural clarification which was provided by the Agency Counsel By Athan. Cm. Perkins’ motion to close the public hearing was seconded by Cm. Livingstone and passed 5-0. Mayor Wilson closed the public hearing. Mayor Wilson noted that the City Council, in session, will consider Resolution No. 2007-14, a Resolution of the City Council of the City of San Ramon Consenting to the Expenditure of Funds by the Redevelopment Agency of the City of San Ramon for Certain Public Improvements Projects. Cm. Perkins motion to adopt Resolution No. 2007-14 was seconded by Cm. Hudson and passed 5-0. Chair Perkins noted that the Redevelopment Agency Board, in session, will consider the Resolution RDA 2007-01, a Resolution of the Redevelopment Agency of the City of San Ramon Authorizing the Expenditure of Funds for Certain Public Improvements Projects. Mbr. Hudson’s motion to adopt Resolution RDA 2007-01 was seconded by Mbr. Livingstone and passed 5-0. Chair Perkins adjourned the Redevelopment Agency meeting at 7:17 p.m. * * * * PLEDGE OF ALLEGIANCE City Manager Herb Moniz led the staff and the audience in the pledge of allegiance. * * * * ANNOUNCEMENTS Mayor Wilson asked if there were any changes or additions to the agenda. The City Clerk noted that there was a request to switch the order of items 10.1 and 10.2. The Council unanimously approved the agenda change. Mayor Wilson asked if there were changes or additions to the schedule of Boards, Committee and Commission meetings. The City Clerk noted that the City Council Team Building Workshop will be held on February 26, 2007 at the Bishop Ranch Conference Center, 2623 Camino Ramon. * * * * SPECIAL PRESENTATIONS (#4.1) City of San Ramon – Recipient of America’s Promise, the Alliance for Youth, "100 Best Cities for Young People", in the United States as presented to Mayor Wilson by the United States Conference of Mayors. Parks and Community Services Director Jeff Eorio and Parks Commission Chair Dominique Yancey announced that San Ramon had received this award. Mayor Wilson stated that it was an honor to meet Mrs. Colin Powell and receive the award for the City. He remarked that San Ramon residents demand the best and City staff provides the best. He thanked the citizens for giving him the opportunity to receive this award. (#4.2) Introduction of New City Employees – Economic Development: Paula Albertson, Office Specialist Engineering Department: Theresa Peterson, Assistant Engineer Finance Department/Central Services: Melissa Rojas, Office Technician II and Karen McHenry-Smith, Telecommunications Specialist. Economic Development Director Marc Fontes introduced Paula Albertson. Mayor Wilson remarked that she is an outstanding representative of the City. Mrs. Albertson said that she has enjoyed a wonderful career at the City and works with great people. Engineering Services Director Joye Fukuda introduced Theresa Peterson. Ms. Peterson will be responsible for issuing special permits, encroachment permits, and providing counter service. Ms. Peterson remarked that it is an honor to work in San Ramon. Central Services Division Manager Pat Perry introduced Melissa Rojas and reviewed her duties. Ms. Rojas thanked the Council for the opportunity to work for San Ramon. Mrs. Perry introduced Karen McHenry-Smith who is responsible for telecommunications for the City. Ms. McHenry-Smith stated that she is looking forward to the opportunities and challenges of her new position. Mayor Wilson welcomed the new employees and presented each of them with a City pin. (#4.3) Recognition of Tom Cooney, Maintenance Specialist, as Employee of the Month for February 2007. Public Services Director Karen McNamara introduced Tom Cooney. Mr. Cooney is a certified landscape technician and works in the parks and landscaping division. He is being recognized as the employee of the month because of his quick thinking in a life threatening situation in which he saved a life. Mayor Wilson thanked him on behalf of the Council and presented him with a certificate and a gold star paper weight. Mr. Cooney thanked the Council and noted that San Ramon is an outstanding city. * * * * CITY COUNCIL APPOINTMENTS * * * * PUBLIC COMMENT The City Clerk noted that there was one request for public comment. Steven Liao, representing the San Ramon Presbyterian Church, thanked the City for its support of the Building Bridges event which was held on October 21, 2006. In 2006, the School District, Fire Protection District, and the Post Office collaborated with the Church on community projects and provided service to seniors, disabled residents, and single parents. Mr. Liao asked residents to set aside October 20, 2007 for this year’s event. Mayor Wilson thanked the Church for organizing the event. He noted that it is an excellent example of the community caring and working to improve the life of San Ramon residents. * * * * APPROVAL OF MINUTES Vice Mayor Perkins’ motion to approve the January 23, 2007 minutes was seconded by Cm. Rowley and passed 4-0. Mayor Wilson abstained. * * * * CONSENT CALENDAR (#8.1) Register of Demands as presented by the City Treasurer (Period ending January 31, 2007). (#8.2) Resolution No. 2007-15 – Repealing Resolution No. 88-54 and Amending Weymouth Court Permit Parking Area by Designating Weymouth Court as Preferential Parking Area "D" and that Parking of Vehicles Without Valid Permit Issued Pursuant to Article 7, Chapter III, Division 9 of Title B of the San Ramon Municipal Code is Prohibited Between the Hours of 7:00 AM and 7:00 PM, Seven Days a Week. (#8.3) Resolution No. 2007-16 – Accepting Certain Roadway and Stormdrain Dedications and Improvements in RA 1148 (Japonica Way) for Maintenance (Shapell Industries – Gallery at Gale Ranch). (#8.4) Resolution No. 2007-17 – Accepting Certain Roadway, Stormdrain, and Trail Dedications and Improvements in Subdivision 8690 for Maintenance (Shapell Industries – Gallery at Gale Ranch). (#8.5) Accept the Work by Top Grade Construction, Inc. for the Construction of Alcosta Boulevard Pavement Rehabilitation Project as Part of the FY 2005/06 Pavement Management Project (CIP 5366) as Complete and Authorize the City Clerk to File a Notice of Completion with the County Recorder's Office. (#8.6) Accept the Work by W. Bradley Electric, Inc. for Phase I of the Construction of City of San Ramon Traffic Signal Installation and Upgrade Project (CIP Nos. 5334, 5373, 5380, 5384, 5385, 5387, 7712, and 7726) as Complete and Authorize the City Clerk to file a Notice of Completion with the County Recorder’s Office. (#8.7) Accept the Work by Site Works Construction Inc. for the Carson Court (CIP 5486) and Reedland Circle Landslide Repair Projects (CIP 5487) as Complete and Authorize the Geological Hazard Abatement District Clerk to File a Notice of Completion with the County Recorder’s Office. (#8.8A) Resolution No. 2007-18 – Approving the 2007-2008 City Council Liaison Appointments to Area Wide and State Wide Committees, City Committees, Council Committees, and Other Agencies. (#8.8B) Resolution No. 2007-19 – Approving the 2007-2008 City Council Appointments to the Southwest Area Transportation Committee. (#8.8C) Resolution No. 2007-20 – Approving the 2007-2008 City Council Appointments to the Tri-Valley Transportation Council. (#8.8D) Resolution No. 2007-21 – Approving the 2007-2008 City Council Appointments to the Central Contra Costa Transit Authority. Cm. Hudson’s motion to approve consent calendar items 8.1 through 8.8 was seconded by Vice Mayor Perkins and passed 5-0. * * * * UNFINISHED BUSINESS * * * * NEW BUSINESS (#10.2) Library Advisory Committee Annual Report. Community Services Division Manager John Skeel introduced Meredith Decker, Vice Chair of the Library Advisory Committee (LAC). Ms. Decker reviewed the purpose of the LAC, their accomplishments in 2006, and their 2007 goals. She recognized the invaluable contribution of 5,008 volunteer hours worked by 95 volunteers. She thanked the Council for their support. Cm. Hudson suggested that the LAC advocate for library use in addition to its advocacy for the building of a City/Civic Center Library. He commended the LAC for their work. Cm. Hudson’s motion to accept the report was seconded by Vice Mayor Perkins and passed 5-0. (#10.1) Informational Report Related to the Measure J Draft Model Growth Management Element. The staff report was presented by Lisa Bobadilla, Transportation Services Manager. Ms. Bobadilla provided background information and outlined the steps required by the City to ensure receipt of Measure J Return to Source funds. The Policy Committee reviewed the draft Growth Management Elements (GME) on January 24, 2007. The Policy Committee and staff support the continuation of the proposed GME as well as the Traffic Level of Service Standards and Performance Standards. The components of the GME were not presented in order of importance. Cm. Hudson stated that he concurs with the report except that different information is provided in the GME than in provided in Table 5.1 of the City’s General Plan. He recommended maintaining the Performance and Traffic Levels of Service Standards included in the Proposed Measure J GME. Mayor Wilson asked if there were any issues in Measure J which may cause concern for the City. Martin Englemann, Planning Director for Contra Costa Transportation Authority, responded that all of the jurisdictions in Contra Costa County are on track to be in compliance with the Measure J and Measure C GMEs. He recommended that the City adopt a GME that is in substantial compliance with Measure J. Mayor Wilson asked what happens to Measure J funds for jurisdictions which are not in compliance. Mr. Englemann stated that the funds would not be divided among jurisdictions in compliance but would be allocated to projects that are not fully funded. He noted that no unallocated funds are currently available. Cm. Hudson’s motion to accept the report was seconded by Cm.
Livingstone and passed 5-0. Staff will forward comments to the
Southwest Area Transportation Committee and the Contra Costa
Transportation Authority by (#10.3) Public Hearing: Introduction of Ordinance No. (next in line) Accepting the Requirements of the California Penal Code Relating to the Recruitment and Training of Law Enforcement Officers. Police Chief Scott Holder provided the report. He informed the Council that adopting this Ordinance will allow the City of San Ramon to apply for state aid for the training of Police Officers under the guidelines of the California Penal Code. At its January 9, 2007 meeting, the City Council approved Resolution No. 2007-07 which accepted the Requirements of the California Penal Code Relating to the Training and Recruiting of Law Enforcement Officers. This Resolution was presented to the State of California Commission on Peace Officer Standards and Training who rejected the Resolution and advised that only a City Ordinance would be accepted. Mayor Wilson asked if all of the local cities use an ordinance to qualify for this reimbursement. Chief Holder responded that the State of California Commission on Peace Officer Standards and Training requires the Ordinance. Mayor Wilson opened the public comment. There were no requests to address this item. Mayor Wilson closed the public comment. Cm. Hudson’s motion to introduce the ordinance, waive the reading, conduct the public hearing and continue the item to the next meeting was seconded by Cm. Livingstone and passed 5-0. * * * * CITY MANAGER COMMENTS City Manager Herb Moniz had no comment. * * * * COUNCILMEMBER REPORTS Cm. Hudson reported that he attended a very informative GHAD meeting and encouraged the Council to attend future meetings when possible. He also advised that the California Transportation Authority will meet on February 28, 2007 to discuss allocation of $4 billion of funding in Contra Costa County. The top two projects are Highway 4 and the Caldecott Tunnel. Cm. Rowley reported that the Senior Citizens’ Advisory Committee conducted a meeting on emergency preparedness. She recommended that residents take advantage of the excellent Senior Breakfasts. They will feature a Chinese New Year Celebration on February 26, 2007 and a Cioppino and Pasta Dinner on March 2, 2007. The Senior Center also provides a variety of free workshops on such topics as Alzheimer’s Disease, mortgages, etc. She commended the San Ramon Historic Foundation for an outstanding. Crab Feed which was held on February 3, 2007. MAYOR’S REPORTS AND COMMENTS Mayor Wilson welcomed back City Attorney By Athan. He reminded residents that the deadline for RV registration is February 28, 2007. He invited residents to participate in the - Run Like the Wind Half-Marathon/5K event presented by Windemere on March 25, 2007. He encouraged residents to submit their application to serve on a City Board or Committee by the February 15, 2007 deadline. Mayor Wilson reported on the recent U.S. Mayors Conference which he attended in Washington, D.C. The mayors from Danville, Dublin, Livermore and Pleasanton met with Senator Feinstein, Senator Boxer and Congresswoman Tauscher and Congressman McNerney to discuss transportation, housing, safety, airport noise abatement, veterans’ affairs, telecommunications and disaster communication inoperability issues. He remarked that the meetings were very productive. He plans to meet with Supervisor Piepho to discuss similar issues. Mayor Wilson invited the public to attend a Special Joint Public Workshop of the City Council, Planning Commission and Economic Development Advisory Committee to present and take comment on the City Center Mixed Use Plan. This workshop is scheduled for February 22, 2007 at 7:00 p.m. at the San Ramon Community Center.
